An inherited property is rarely just a property

Most inherited homes have been standing still for a while. The air conditioning has not run properly, the roof is whatever age it is, and the last serious work happened a long time ago. That is normal and it does not stop a sale.

The harder part is usually everything around the house. Several people may have an interest in it, they may live in different states, and they are making decisions during a period when nobody particularly wants to be making decisions at all.

Can a property be sold before probate is finished?

Sometimes a sale can be arranged while probate is still running, but whether it can complete depends on the court and on how the estate was left, and the rules differ by state. Your attorney decides that. What we can do is give you a figure to work with while it is being sorted out.

Do we have to empty the property first?

No. Take what matters to the family and leave everything else. Clearing it out is not something we ask you to do before we will look at the property.

There is still a mortgage on it. Does that stop this?

No. A mortgage is paid off out of the sale at closing in the normal way. If the balance is close to the property's value, tell us early, because that changes what is realistic.

Several of us inherited it and we do not agree. Can you still help?

We can give you a figure, which is often the thing the disagreement is really about. We cannot make the decision for the family and we will not pressure anyone. When everyone is ready, we are ready.

Should we make repairs before speaking to you?
